From the speech of the President of the Republic of Kazakhstan on the Anti-Corruption Forum of NDP “Nur Otan”

A civil servant shall be guided by the following ethical standards:

1. State employee must be able to dispose of the power and authority and still be honest.
2. In the public service one should work for the good of the state, not for his own well-being, not to confuse public funds with his own pockets.
3. Official should live without a fear of the question «How do you make a living?» Because there should be no reason for the appearance of pictures of his villas, high fences around them, and expensive cars.
4. It is important to live in a harmony with the requirements of the law.
5. In any post it is necessary to work so that under no circumstances not to lose the trust of the people, the citizens of the country.
6. Kazakh government official should be an example of justice, humility, able to behave in humans.
7. Before managing a team, he has to learn to obey, to be able to perform what he requires from his employees.
8. We must immediately intervene, take action, if you see that anything harms the interests of the state or any act of corruption is preparing.

In order to increase the requirements for moral and ethical aspect and the professional qualities of public official, I hereby DECREE:
1. To approve the code of honor of civil servants of the Republic of Kazakhstan (Rules of ethics of civil servants).
2. Shall be deemed as null and void:
1) The Decree of the President of the Republic of Kazakhstan dated January 21, 2000 N 328 «On approval of rules of ethics of civil servants of the Republic of Kazakhstan» (CPGA of the Republic of Kazakhstan, 2000, N 2, p. 16);
2) The Decree of the President of the Republic of Kazakhstan dated May 7, 2002 N 866 «On amendments and additions to the Decree of the President of the Republic of Kazakhstan dated January 21, 2000 N 328» (CPGA of the Republic of Kazakhstan, 2002, N 14, art. 137).
3. This Decree is enacted on the date of its signature.

of Civil Servants of the Republic of Kazakhstan
(Rules of ethics of civil servants)

Carrying the public service is an expression of special confidence of the society and the state, and makes high demands of morality and ethical standards of civil servants.
The Society expects that the civil servant would put all his strength, knowledge and experience in professional activities that he carries out, that he would serve his country — theRepublic ofKazakhstan — impartially and honestly.

This Code of honor of civil servants of the Republic of Kazakhstan (the Rules of ethics of civil servants) (hereinafter — the Code) sets basic standards of conduct for public servants of the Republic of Kazakhstan in accordance with the Law of the Republic of Kazakhstan dated 23 July 1999 «On Public Service», the Law of the Republic of Kazakhstan dated July 2, 1998 «On Fight against Corruption» and generally accepted moral and ethical standards.

1. In their activity civil servants should:

1) be committed to the policy of the President of theRepublicofKazakhstanand consistently implement it, to strengthen the authority of the government by their actions, to protect the interests of the state, to avoid taking actions which may discreditKazakhstan;

2) be governed by the principle of legality, strictly observing the Constitution and strictly following the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan;

3) ensure the observance and protection of human rights, freedoms and legitimate interests of citizens, to avoid actions associated with a violation of the rights and freedoms of man and citizen;

4) assist in strengthening the unity of the people ofKazakhstanand ethnic harmony in the country;

5) maintain state and labor discipline strictly, perform his or her duties honestly, impartially and efficiently, using their time for this effectively;
6) make every effort to highly professional work, apply optimal and economical methods of solving any tasks, take care of the entrusted public property, use it rationally and effectively;

7) resist manifestations of corruption;

8) exclude actions that are detrimental to the interests of the public service, not interfere in the activities of those who involved in the decision-making on matters affecting the personal interests of a civil servant;

9) prevent interference in the business and lobbying interests of individual businesses;

10) prevent the use of confidential information for financial gain or other personal purposes;

11) not participate in money or other property-related gambling with superior or inferior or anybody else who is in a different service or work dependence with them;

12) not allow facts accepting gifts or services from natural and juridical person in connection with the performance of public functions;

13) not accept an invitation to the domestic and foreign travel, health and recreational and other trips at the expense of Kazakhstani and foreign individuals and legal entities, except cases that are established by law;

14) contribute to a sustainable and positive moral and psychological climate in the team showing their attitude and personal behavior;

15) resist actions that hinder the effective functioning of government and the proper performance of duties by civil servants;

16) avoid any personnel selection and placement on the grounds of national groups, and personal devotion;

17) prevent and suppress violations of professional ethics by other civil servants;

18) adhere to the business style of dress during the performance of their duties.

2. In relations with the citizens and legal entities public servants must:

1) enhance public confidence in the institutions of the state;
2) show modesty, not emphasize and not use their official position, including moments when receiving freight services and other benefits;
3) not give cause for justified criticism from the society by their actions and decisions, avoid persecution for criticism, tolerate it, use constructive criticism to correct deficiencies and improve their professional activities;
4) prevent manifestations of bureaucracy and red tape in processing applications, take appropriate measures on time;
5) respect the honor and dignity of a person and citizen, regardless of their origin, social, property status, sex, race, nationality, language, religion, beliefs, place of residence or any other circumstances;
6) comply with generally accepted ethical norms, show respect for the state and other languages, traditions and customs of the people of Kazakhstan; Z970151
7) be polite and correct.
3. Civil servants that have employees in their subordination must:
1) define objectives and scope of official authority of their subordinates exactly according to their positions, not give them unrealistic orders and not require fulfillment of orders that are not related to their official duties;
2) prevent unfounded allegations, facts of rudeness, humiliation of human dignity and indelicasy in relation to subordinates;
3) not compel subordinates to commit illegal acts or acts that are incompatible with accepted ethical standards.
4. Public speaking on the activities of public authorities are realized by its the manager or authorized officials of the state body.
Civil servants need to hold discussions in the correct form, not undermining the authority of the civil service.

5. Civil servants should not publicly express their views on public policy and service activity, if it:
1) does not fit with the basic directions of state policy;
2) disclose proprietary information, which is not permitted to be made public;
3) contains unethical statements against government officials.

6. In the presence of unfounded public accusations in managing of commercial organizations and / or business activities, lobbying anyone’s interests directed against a civil servant, he should properly disclose information to refute such allegations.

7. In case of public accusations in corruption, he should take actions to disproof them, also judicially.

8. Observance of the present Code by public servants is their duty.

9. Civil servants can be called to account for violation of the provisions of this Code, according to the legislation of theRepublicofKazakhstan.

10. The collective of state agency by decision of the official, who is authorized to make appointments and dismissals of civil servants, can consider fact of non-observance of this Code by civil servants and make public reprimand after considering.
